Terms of Service

1. Who we are & the agreement

Mondai is operated by Aleš Vychodil, a sole trader (fyzická osoba podnikající) with a registered place of business at Milady Horákové 339/42, 602 00 Brno, Czech Republic — IČO 09740074, VAT ID (DIČ) CZ8507026143. By creating an account or using Mondai you agree to these Terms. If you do not agree, do not use Mondai. If you use Mondai on behalf of a business, you confirm you are authorized to accept these Terms for it.

2. The service

Mondai is an AI content assistant that helps you plan, generate, and publish social media content. It connects on your behalf — only after your explicit authorization, through official APIs — to the platforms you choose: Instagram, Facebook, Threads, TikTok, YouTube, Pinterest and LinkedIn.

We actively develop Mondai, so features may be added, changed, or removed over time. We will let you know about significant changes when we reasonably can.

3. Eligibility & your account

You must be at least 16 years old (or the age of digital consent in your country) to use Mondai. You are responsible for keeping your login credentials safe and for all activity under your account. Tell us immediately if you suspect unauthorized access.

4. Your content

You own the photos, captions, videos, and posts you create or upload. You grant us a limited licence to process this content only to provide the service — running AI analysis, showing it back to you, and publishing it to the platforms you connected.

You confirm you have the right to use any content you upload and that it does not break any law or infringe anyone's rights.

5. AI-generated content

Mondai uses AI models to generate captions, titles, descriptions, hashtags, and recommendations. AI output can be wrong, inappropriate, or repeat patterns from training data. You are responsible for reviewing and approving everything before it is published — Mondai never auto-publishes without your approval. Subject to these Terms, any AI output generated for you is yours to use.

6. Platform rules

When you use Mondai with Instagram, Facebook, Threads, TikTok, YouTube, Pinterest, LinkedIn or any other platform, you must also follow that platform's own terms and community guidelines. Mondai is not responsible for actions those platforms take against your account.

7. Acceptable use

Do not use Mondai to generate or publish content that is illegal, deceptive, hateful, or that violates anyone's rights. Do not try to break, reverse-engineer, overload, or abuse the service. We may suspend or terminate accounts that violate these rules.

8. Pricing & payments

Some features require a paid subscription. Current prices and plan features are shown in the app and on our pricing page; prices include VAT where applicable. Paid subscriptions renew automatically for the same period until you cancel, which you can do any time from your billing settings. Payments are processed by Stripe.

9. Refunds & right of withdrawal

If you are a consumer in the EU, you have a statutory 14-day right of withdrawal from a distance contract. Because Mondai is a digital service that starts immediately, by subscribing you ask us to begin providing it right away and acknowledge that you lose this 14-day right once the service has been fully performed.

Beyond your statutory rights, we handle refunds in line with our then-current refund policy (any "money-back" offer we advertise applies on those terms). We may decline a refund where we detect abuse — for example heavy use followed by a refund request, repeated refund requests, or a breach of these Terms.

10. Termination

You can stop using Mondai and delete your account any time from Settings. We may suspend or terminate your account if you breach these Terms. After termination, your data is deleted as described in the Privacy Policy.

11. Disclaimer & liability

Mondai is provided "as is". We do not guarantee it will be error-free, available 100% of the time, or that AI output will be accurate. To the extent permitted by law, our total liability is limited to the amount you paid for the service in the 12 months before the event giving rise to the claim. Nothing in these Terms limits liability that cannot be limited by law, including your mandatory consumer rights.

12. Governing law & disputes

These Terms are governed by the law of the Czech Republic, without prejudice to the mandatory consumer-protection rules of your country of residence. If you are a consumer, you may use out-of-court dispute resolution; in the Czech Republic the competent body is the Czech Trade Inspection Authority (Česká obchodní inspekce, www.coi.cz). The competent Czech courts otherwise have jurisdiction, again without prejudice to your rights as a consumer.

13. Changes to these terms

We may update these Terms as the service and legal requirements evolve. If we make significant changes, we will notify you (for example by email or in the app) before they take effect. Continuing to use Mondai after the changes take effect means you accept the updated Terms.
